Participation Agreement

Before a camper may attend and participate in our camp activities, that child’s parent(s)/guardian(s) must read and accept, by physical or electronic signature below, the following Participation Agreement. This is a legally binding document, so we ask that you read it carefully before signing.

In this agreement Latin Roots Cultural Project includes its directors, officers, employees, instructors, staff, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, and assigns.

I, the parent or guardian, for myself, any other parent, and the minor on whose behalf I sign, in connection with my son/daughter attending and participating in Latin Roots Cultural Project “Summer with Amigos” camp hereby agree as follows:

Acknowledgement of Risks

I understand that participating in Latin Roots Cultural Project “Summer with Amigos” camp means engaging in activities including, outdoor and indoor games, play, lessons and crafts; play on an outdoor spray park; washroom visits, resting, eating alone and in groups, walking on sidewalks and crossing streets (collectively referred as “the Activities”). I understand that the Activities involve many risks, dangers and hazards including, but not limited to falls, slips, trips, cuts, insect bites, prolonged exposure to sun; the condition of the field, grass and areas used including slippery and jagged surfaces; changing weather conditions including lightning; exposure to infectious disease contracted through viruses, bacteria, parasites, and fungi, known and unknown, which may be transmitted through direct or indirect contact, which includes COVID-19; accidents during participation in the activities, choking, negligent first aid; failure to act safely or within one’s own ability or to stay within designated areas; encounters with domestic and wild animals including dogs; negligence of other persons; and risks resulting from the negligence, breach of contract, or breach of any statutory duty of care on the part of Latin Roots Cultural Project. I understand that negligence includes failure on the part of Latin Roots Cultural Project to take reasonable steps to safeguard or protect me from, or warn me of, the risks, dangers and hazards. I am also aware that the risks, dangers and hazards referred to above exist throughout and beyond the indoor and outdoor areas, fields, parking lots, sidewalks, paths, and other areas used for the Activities, and that not all hazards are marked.

Assumption of Risks

I understand, freely accept, and fully assume for myself and on behalf of any minor for whom I sign below all the dangers, hazards and risks of participation in the Activities which could result in personal injury including and not limited to breaks, cuts, muscle sprains, muscle strain, broken limbs and teeth, heat stroke, bruises, illness, aggravation of pre-existing conditions, death, or property damage or loss. I hereby assume these risks and, knowing them, hereby give my child permission to participate.

Waiver of Claims and Indemnity and Release of Liability

In consideration of Latin Roots Cultural Project allowing me to participate in the Activities and allowing my use of the indoor and outdoor areas in which the Activities take place (hereinafter “the Facilities”), I, an adult, or as the parent or guardian of a minor who is participating in the Activities, for myself and on behalf of that minor, hereby agree as follows:

I hereby WAIVE any and all claims that I, or anyone having a relationship to me may have now or in the future against Latin Roots Cultural Project arising from my use of or presence on the Facilities, or transit to or from the Facilities.

I hereby WAIVE, RELEASE, AND DISCHARGE Latin Roots Cultural Project from any and all liability for any loss, damage, expense, and injury and death, or actions of any kind, including any claim for contribution and indemnity, that I may suffer from participation in the Activities due to any cause whatsoever, including without limitation negligence, breach of contract and any duty of care owed to me by Latin Roots Cultural Project under the Occupiers’ Liability Act. I understand that negligence includes the failure on part of Latin Roots Cultural Project to take reasonable steps to safeguard or protect me from the risks, dangers and hazards referred to above, or to warn me of said risks dangers, and hazards.

I hereby INDEMNIFY AND HOLD HARMLESS Latin Roots Cultural Project from any and all liability, including claims for contribution and indemnity, for any damage to property of or personal injury to, any third party, resulting from my, or my family member or next of kins, use of the Facilities and property, and participation in the Activities.

Photo and Video Waiver and Release

By registering for “Summer with Amigos” camp, I acknowledge that camp photos and video of campers will be taken during camp activities and that they remain the sole property of Latin Roots Cultural Project. These photo and video materials may be used in current and future print & online marketing and promotional campaigns including our website and other digital platforms.

Conditions of Registration

I/we hereby agree as follows:

That the Directors of Latin Roots Cultural Project reserve the right to terminate the registration of any camper when it is deemed by the Directors to be in the best interest of the child or the camp. In such an event, it is at the discretion of the Directors of Latin Roots Cultural Project whether to provide a proportionate refund.
Parent(s)/guardian(s) agree to check the Camp Overview section on the website to ensure availability of spots in the week they intent to register their child for before submitting a registration.
Campers will only be permitted to attend camp once a complete registration is submitted, which includes full payment of all camp fees.
Our camp participation fees are for a specific period and not a day-to-day fee.
I hereby agree to pay for the repair or replacement of any property that I or my child break or damage as a result of direct or indirect behavior.
Parent(s)/Guardian(s) agree to the Cancellation and Refunds policy specified in our Camp Policies on the website at www.latinrootsproject.org
There are no refunds under these circumstances: missed days for any reason, cancellations made within 3 days prior to camp-week start, camp-week already started, inclement weather, days the camp was unable to open/was required to close due to circumstances beyond the control of Latin Roots Cultural Project.
Latin Roots Cultural Project staff is not responsible for lost, stolen or damaged belongings.
Latin Roots Cultural Project reserves the right to adjust or change our programming as needed due to any factors affecting our camp programming.
The parent(s)/guardian(s) hereby understand that Latin Roots Cultural Project will have zero-tolerance for physical and/or verbal abuse towards any staff, camper or other guests. Any person found in breach of this condition may be asked to terminate their child’s time at camp.
Parent(s)/guardian(s) agree to all Camp Policies stated in our website at www.latinrootsproject.org

Jurisdiction

This agreement and any rights, duties and obligations as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of Saskatchewan and no other jurisdiction. Any litigation involving the parties to this agreement shall be brought solely within Saskatchewan and shall be within the exclusive jurisdiction of the Courts of Saskatchewan.

Severability

If any provision of this agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions hereof, and each provision is hereby declared to be separate, severable and distinct.

Entire Agreement

In entering into this agreement, I am not relying upon any oral or written representations or statements made by Latin Roots Cultural Project with respect to the matters covered by this Agreement other than what is set forth in this agreement.

Acknowledgement

I have read and understand this agreement and I am aware that by signing this agreement I am waiving certain legal rights which I, and the minor child on whose behalf I sign, may have against Latin Roots Cultural Project. This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.

I certify that I am authorized to sign this release without the consent of any other person.
